DEMOCRACY ON LIFE SUPPORT: CALIFORNIA SENATE BILLS SB 50 AND/OR SB 35 AND THE DETRIMENTAL EFFECT UPON PUBLIC COMMENTARY AND/OR THE DEMOCRATIC PROCESS IN GENERAL

After finally finishing up my latest submission to George Hills Company that exposed nearly 20 years of police misconduct that I experienced due to my involvement in activism; I had a warm sense of accomplishment. Because I knew that I finally cut through their crap and exonerated myself without the help of a lawyer; establishing factual innocence after being stalked and harassed nearly to death -- and then somehow accused of the same thing -- at least partially due to my valiant activism that brought the entire neighborhood together and deepened democracy by saving the Peterson field from another similar secret development to the one that is presently being considered at Peterson that was proposed back in the early 2000s.

I heard from a friend who lives in the neighborhood that there is a plan for putting the pool out in the parking lot; which sounds like a crazy idea to me. That's all I really know so far. But this plan would not only generate noise for the neighbors surrounding the parking lot; but it would also force swimmers to travel farther to the locker rooms for showers as well. And now that most of the redwoods along the tennis courts are gone it will be noisier for the neighbors even if the pool is restored to it's original location. The SCUSD is making some drastic changes without thinking through the implications of doing so; and this is why the public hearing process is so important. Because the NSA public hearing process of mass-surveillance is not the answer...

I mean just think about it: by bringing the neighborhood together and brainstorming on what the fate of the Peterson field was going to be ten years ago; instead of following through with SCUSDs cockamamie plan to move the football field etc (a plan that was stopped by one lady I gave a flyer to who suggested football fields are oriented the way they are for a good reason so players don't have to kick or throw into the sun in during the winter time when the sun sets early) we ended up with the Full Circle Farm and now the SCUSD farm (you're welcome) and now many other schools have followed suit and are adding gardens and small farms as well (you're welcome)...

This started a revolution of sorts bringing us back to our old Valley of Heart's Delight farming days (you're welcome again) adding much needed balance to a presently unbalanced situation with precious farmland and open space disappearing at a fast rate and being replaced with the ugliness of yet more new development...

But that warm sense of accomplishment was really the calm before the new storm; a psychic feeling I get before any new shit hits my fan; as after nearly a decade of being jerked around by local official idiots for being so influential in the community and finally turning the table on them and exposing all of their lies and deceit; here is yet another stupid idea that appears not have not gone before the community just like the secret plans ten years ago. They are doing what they so badly wanted to do 10 years ago with the help of Gavin Newsom and the California legislature.

And the one place I finally found happiness playing basketball during the low moments after being allowed to be stalked and harassed and menaced nearly to death now has a fence around it. And somehow I feel someone knows this and that is why this particular parcel was targeted. I know it sounds paranoid but it would not surprise me one bit. While the protection of the Peterson field was initially more (for me) about protecting the wildlife in the field; the protection of the basketball courts is about protection of people and their interests.

Note: The last time I played basketball before this was about 30 years ago at the Patrick Henry parcel the night that I got a call to fly out and fill in playing drums on a tour of the southern United States and Puerto Rico with a band called Jetboy...And I suppose that experience left me so reeling for so many years that I totally forgot that I loved playing basketball; which I did whenever I could on the tour in basketball arena warm up courts at large venues we played...
But this is what government wanted all along; to just do whatever they want and ignore constituents while they suck up to their developer interests. Gavin Newsom said something a few years back after returning from back east about how easy it was for them to put up skyscrapers in New York (for example) without dealing with local community concerns. But local constituents may also balk when reelecting the jokers responsible for it in the next election due to the democracy-killing effects of new California state laws SB 35 and SB 50. Local leaders should be able to control the land within their city limits but Gavin Newsom wants to strip them of that power. 

The democratic process of gathering comments about important issues is much like a vote in a very large sense; so if people cannot be heard about issues that matter to them most then that would be the equivalent of violating their sacred voting rights.

So I used to think Gavin Newsom would make a great president; but now I actually officially think he is extremely dangerous in too many ways. I already decided to never vote again due to what the State of California and/or Gavin Newsom and the California State Legislature did to Proposition 215 and the medical patients the State of California promised to help out with their new law. But now Proposition 35 and 50 have pushed me away even further to the point of no return.


Newsom has not only turned on backwoods growers with Proposition 64 by making them illegal after promising to help them (I smoked untested weed for 40+ years without incident) but Newsom also recently increased taxes on legal pot up to 50 percent from where they were at 30 percent. 

Newsom is also pressuring cities to develop precious last parcels of land that no one wants to destroy; therefore a county-wide system is needed rather than a city-wide system of forced housing development. Counties naturally have more land to deal with and trade off between cities so that is what is needed at this juncture. Newsom needs to think bigger and take more people and things into consideration.

So this essentially makes Governor Newsom a two-faced; back stabbing; lying tyrant and thief of sorts in the minds of many who are now talking about recalling him from his place as governor. And SB 50 and SB 35 have shown that Newsom is a democrat who does not want to practice deepened democracy as he kills it. 

It's not just people in Hong Kong who want deepened democracy; because the people in America want it too and always have. It's also called 'local control' by some; and that is really all about increasing New Hampshire-style democracy allowing every voice to rise and make a difference. So the Democratic party at least here in California has in many ways gone over the edge of oblivion and thrown the democracy that used to define their party into the dumpster.

In China the population has grown so large that they probably cannot allow people to have a voice in local matters; and Democrats can have a tendency to do the exact same kind of thing. They create such a big family that they cannot possibly take care of all of the constituents that they love to regulate like little children; forcing them to resort to drastic undemocratic measures to cram in a few more human sardines to boss around. I was always supportive of illegal immigration until I found out that it helped to create a situation where the eventual goal of deepened democracy was being severely compromised and eventually ended as it is now. 

But people being forced out of the rain forest and other regions is what is causing the latest recent uptick in immigration influx; so until peoples' homelands are made to be secure they will continue their immigration flight. Anyone would do the exact same thing given the same situation.

But aside from these empathetic feelings that I cannot help but feel; many people complain about their tax money being spent on and/or given away to illegal immigrants; which is definitely a concern I suppose -- but it's another thing altogether when your voice starts getting minimized for them. At some point in time it makes you finally decide to draw a line in the sand for the protection of your own rights.

(Gavin Newsom grew up in San Francisco and actually likes it there; while most of California does not want San Francisco values thrust upon them by forcing development in areas where it has been deemed off limits over and over again by the local community. San Francisco is land locked unlike most of California; and most people simply don't want or like the pressures of a land locked region determining what they do. I used to like San Francisco but now I avoid it due to traffic and crime and the mess on the streets; and not to mention the half-truthed and racist liberal 'white entitlement' racial slur dialogue that permeates the SF region. San Francisco is very hateful and dangerous and traffic congested and dirty and etc etc etc. Not my kinda place. But it did not used to be that way. I love Santa Cruz though for what it's worth. Therefore I will do whatever I can to make sure my local region does not end up a God awful mess like San Francisco. I have been hyper aware of the wonderful relative open air quality our valley has for many years after a delivery driver I spoke to commented on how nice it is down here in the Santa Clara Valley compared to where he had just been up in SF)

And while I am living proof that some people are purposefully allowed to slip through the financial cracks and get thrown away like human trash along like so many others who are actually homeless in this region (then receive a tax bill for it) but it is another issue altogether when the collective voices of the local community are metaphorically thrown in the trash as well. At least I have a home to live in; but I know all about the plight of the homeless because I am a low income white male in a place where low income white males are generally discriminated against; so I totally 'get it'.

That said; drastic solutions like ending the democratic process is not necessarily the answer. Remember that the term 'democratic solutions' applies to lifting the voices of all people regardless of political affiliation (in other words; protecting democracy also protects Republicans too and everyone else who may have an opinion on important community matters). But this is the norm around here in Silicon Valley as corporations that democrats so coddle lay waste to the Mom and Pop and mall store universe; leaving a trail of homeless people a million miles long as Jeff Besos and other corporate leaders bribe government to make more housing for their employees who are barely making ends meet.

So when all is said and done there will still be a homeless problem due to the lack of affordability of new housing being created; democracy will be killed in the process as people just like me will increasingly turn from being involved in local issues and/or voting; and important environmental laws that took many years to establish will ultimately be ignored as the wrecking ball decides our collective fates.

AFTER EXTENSIVE PUBLIC HEARINGS AND PUBLIC VOTES TRYING TO DECIDE THE FATE OFTHE OLD VALLCO MALL; GAVIN NEWSOM AND CALIFORNIA BILL SB50 MADE THE DECISION FOR US ALL BY ALLOWING A WRECKING BALL TO BE USED AS A HEAVY-HANDED 'AGENT OF DEMOCRACY'...
And the low income people who struggled to survive for so long will slowly age and lose their ability to work and end up on public support of some kind. So you can either lower their taxes and/or rents now and allow them to have more money later in life and/or allow landlords and government to take more money now and pass the buck down the line to other high income earners in the future in the form of increased taxation for the needs of public assistance. 

The bottom line is: Either way the rich will end up paying the price in the end unless the rents and taxation of low income people are severely curtailed. And how much do you wanna bet the State of California is taxing homeless people who live in RVs and tents; wondering why there's a homeless problem?

And what is going to happen in ten years? Whatever is done now should be taking that into consideration so no more drastic deepened democracy-killing measures are created or utilized in the future to further ruin our once golden California reality. 

Because 'they' are out there making more people as we speak and those children are all going to need to live somewhere; but NOT IN MY BACK YARD! I predict that if all of this occurs as planned by Gavin Newsom; then it will become so much more congested in big and small California cities than it already is (there is now gridlock traffic on the freeway in LA at 9 pm) that people will ultimately flee the region in droves larger than what is already occurring now due to decreased quality of life and/or lack of excessive taxation and/or rising gas prices and/or crime and/or homelessness and/or excessive traffic and/or the forced vaccination of children and/or eventually adults (OMDB!) etc etc etc off into the crazy liberal universe of highly taxed and regulated 'freedom'...

"DON'T FENCE US OUT!: Ok let's see...I saw the construction zone fence around the basketball courts where I found  happiness during my lowest moments in the last few years (go to: https://lreblogger.blogspot.com/2019/11/case-related-information-2019_18.html > the city council already knows all about this situation) and the  tennis courts are surrounded by the construction zone fence as well...It  was a shock to see the bleachers closed off initially...It has sort of  been in limbo ever since...

Then the pool was taken out where Peterson  High-era Olympic swimmers trained and/or where noisy and fun swim  lessons go on every summer...Then the line of redwood trees was  removed?!? Luckily I cloned a couple trees from the sprouts  around the base of the some of the trees before they were removed; and  got one amazing tree with excellent DNA (see photo at top of page) It was a  1/4 inch sprout at the bottom of a tree I got during the summer...

And  while it is a great feeling to know that I got this redwood tree clone  -- it was absolutely devastating to see all of those redwood trees  gone...I suppose I should have known that something was up...The new  construction fence made me realize there has been some kind of plan all  along...

Just remember that I have sacrificed much of my time and  freedom and happiness that I enjoyed for almost 50 years in this  neighborhood for merely standing up for the concerned local community  who I extended deepened democracy out to during the pre-Full Circle Farm  era (deepened democracy Gavin Newsom wants to end)...

I arranged  to hold a community meeting in the Peterson Cafeteria (where I by the  way played drums at the Peterson Variety Show during my freshman year at  Peterson High School) A community meeting I asked to be purposefully  held before the November DST time change to allow people to attend  meetings before winter time when people tend to go out less after  dark...Also; it was closer to home and easier to attend...The way it  should be all the time...

Needless to say; I  am very  disappointed that this new construction idea was thrust upon the public  during the holiday season...It is a slap in the face to the deepened  democracy that I worked so hard to establish over the years; as the  trust of the community who cares so much about the future of the  Peterson parcel has now been compromised...And out of that cafeteria  meeting came the Full Circle Farm idea; which later morphed into the  SCUSD farm (you're welcome)...

At the time I had an idea of  using the tennis courts straight out to Bryant Way for high density housing perhaps partially reserved for teachers...

Since only 2-3 tennis  courts are used at any given time; I figured maybe redo the basketball  courts and make it into two tennis courts and about 15-10 basketball  courts with walkways along the sides instead of whatever it is now 15  courts or so (note: local Indian folks used to walk around the  basketball courts when the trees where there; but I don't see them  walking there anymore)  I think this tennis court redevelopment idea is  still a good one if housing is being planned for the entire parcel now  surrounded by constuction fence...

But if a new  exercise area with new basketball courts and tennis courts is being  planned; then I am all for it (see attached Ozaki Plaza 1 photo -- Mrs.  Ozaki initially gave me the leaked SCUSD document showing the initial  SCUSD plans for the Peterson field so I figured why not name it after them?)

But I doubt that is the plan...Look; I know we have  a less active younger generation relative to the older generations who  came before them; but not only do I regularly shoot hoops at Peterson --  I also see countless parents out there during their golden hours after  work with their kids playing basketball too...And countless pickup games  by active youth go down at those basketball courts as well...

I see it  all the time when I am playing basketball...I'm like the janitor in the Breakfast Club movie; I see and hear many things...Anyway...

One  other issue I wanted to mention is; why have all of the exercise  machines provided by the 49ers been rendered inaccessible? This is  terribly disaffecting the neighborhoods' health and well being...It  looks like they are being protected; but no  one can get to them...What  is up with that? I get the feeling we have a new set of SCUSD trustee  jokers who have no idea about the precedent that I have set within this  community to make more informed decisions...So I ask that the SCUSD slow down on whatever they have planned and allow the local community to  make a difference like they did before -- as we always know best...

Maybe  a meeting in the spring time? In response to all of this; I will be  drafting some community fliers to distribute around the neighborhood to  get people re-involved and re-empowered and re-connected to those people  who can help them make a difference once again...So don't don't freak  out if you see any of my fliers around here and there and/or received emails from concerned folks; it is a constitutionally protected act...

And  besides; I just put in a claim to George Hills Company to clear the way  for me to get back involved in the community activism that I was  temporarily destabilized out of for the last few years by police misconduct etc...All for now..."

HERE'S MY ORIGINAL MARIAN A PETERSON HIGH SCHOOL CLOSED-GROUP FACEBOOK POST WHEN I REALIZED THE REDWOODS HAD ALL BEEN REMOVED: 12 OCT 2019 / BREAKING NEWS: "All of the redwood trees on the edge of the tennis courts (only those along the basketball courts -- but about 10 or so trees) were completely removed and mulched as of this week...I suppose they were not getting as much water as tall redwoods like this need and therefore were not as healthy as they could have been -- but a few years ago I did manage to take some cuttings at the bottom of one of the trees...And sure enough one of the clones later turned into a healthy, fast growing tree seen in the attached photo...It initially shot out two branches going upwards from the singular cutting; but then another branch started shooting straight up from the base of the new tree...So I finally got up the nerve to cut the two branches to manipulate the one shooting straight up because it was going to grow unusually and U shaped; and it worked perfectly...Now I am going to get another bag or two of Fox Farm Ocean Forest soil and put the tree in a bigger pot before I finally plant it somewhere where it will get ample water...A forest ranger I spoke to on Facebook once said these trees generally grow on mountainous down slopes where ice melt from higher altitudes provides enough water; and/or along streams on valley floors etc...So I will clone as many new trees from it as I can for the next few spring time seasons and eventually plant this tree in the ground along with the others where they will be allowed to grow undisturbed...It's sad to see all of those trees gone; but this one tree is the saving grace in all of it..." Note: With some amended soil and fertilization the lesser trees could have easily bounced back; but too late now I guess...The problem is redwoods that grow inland tend to have less thick foliage due to getting less water than those that have grown naturally in certain choice spots in the surrounding mountains...I even had an idea that the SCUSD could start a program where clones were taken from the bottom of the redwoods then grown and taken elsewhere since trees are increasingly being seen as our ticket out of the climate change situation (I've known that for years DUH!?!) and I suppose this could still be done with the remaining trees if they are going to be protected that is...All is not lost though; because I have some of the best DNA from the base of one particular redwood that was taken out and this can be technically cloned endlessly...I could start an entire forest out of this one tree...It's something from nothing and it's magical...

To think that I stuck my neck out for my neighbors and sacrificed so much of my life and time and freedom for deepened of democracy; all of that effort to inform and include the public in the process way beyond what was happening at the time in my neighborhood with tiny flyer signs on sticks carefully hidden under bushes down the street -- has now been trashed for Gavin Newsoms' wanton destruction of democracy...


UPDATE 26 NOV 2019 / I spoke to some students yesterday who told me that they are redoing the entire blacktop area (basketball courts etc) which is what I suspected all along; so I am glad to hear it...I am just more than a little bit concerned about the way it was done removing all of the mature redwoods (did they get permits for this? And what was the 'good' reason for doing this?) and/or planning on moving the pool to the parking lot (?!?) without running it by the affected neighbors to attain some semblance of a deepened democratic state...The Peterson bleachers were the start of all this; and their fate still remains in limbo regardless of the fact that Peterson High alumni agreed to fix them themselves on their dollars...So it's good to hear this news; but the fact remains that I cannot access my favorite basketball court for an unknown amount of time; and this is causing me an enormous amount of emotional distress...I will get through this somehow though...Other than that; I stand by everything that I wrote in this blog post; as it all needed to be said...The conspiracy against human and/or civil rights lies within democrats at the state government level...This is an undeniable fact CNN (stop trying to control the narrative)...And since I was running on scant knowledge at the time; all that was left to do was assume so I kept it vague; broad and far-reaching in scope...And I never actually believed that houses would be put in the middle of a school playground (the Ozaki plaza idea is a good one though) but the way the desperate State of California is acting lately forcing people to develop their precious land often against their will; it would not have surprised me one bit...Just letting them all know that there is dissent out there; and that nothing goes unnoticed...

UPDATE 30 NOV 2019 / I spoke to an SCUSD maintenance person who happens to be a friend of mine and he said they are being kept in the dark as to what is going on within the construction zone at Peterson...It seems that some students know more about it than he does which is very interesting...Either way; as the power usurping; unapologetic; unafraid and unabashed self-appointed Mayor of Southwest Sunnyvale I have decided that since it appears the basketball courts are apparently being redone and since I play basketball as well I then officially approve of this project and am now letting it go through for now until further notice...Although i will keep a close eye on the progress to make sure it stays in line with the Birdland Neighborhood ethic...

What concerns me most is that these Redwood tree were removed right after the Rain forest was burning in the background during the summer of 2019 and/or right after I brought attention to what PG&E did in Santa Clara...And sure there are lots of coastal redwoods up in the mountains but not so many down here in the valley...Environmental protection is not just for tree huggers; and protecting the environment is not just 'someone else's problem'; protecting the environment can be everyone's solution as we are all part of this thing we call 'the environment' whether we like it or not ~ as we all came up from the dirt...And our actions can have drastic consequences good and bad; so let's start taking drastic action for the good while vanquishing the bad...

California bills SB 50 and SB 35 could be seen as dissuading witnesses; placing these new laws in direct conflict with preexisting California law which prohibits the dissuasion of witnesses of any kind. Dissuading a witness is a punishable offense. It is a crime under California PC 136.1 to knowingly and maliciously prevent or dissuade a witness or victim from reporting a crime, or attending or providing testimony at any trial, proceeding, or inquiry authorized by law. / Dissuading a Witness – Penal Code 136.1 PC: You know that someone may have seen you or a loved one commit a crime, so you decide to go over and speak to that person and help them understand it was a mistake. “You didn’t see what you thought you saw,” you tell them. “Do me a favor and don’t say anything,” you ask of them. UPDATE / 17 DEC 2019 / EMAIL MESSAGE TO SCUSD TRUSTEES ETC: "Ok I suspected no one would answer back...It could be due to the holidays but I doubt it...Many of you SCUSD folks saw my last email I suspect...Anyway; most school district trustees are these sort of novice local individuals who were encouraged to run for their seat by their Auntie Janie or whatever; so I don't expect any responses...

Don Sun would have been the exception due to his experience in Cupertino government and/or the way the Vallco situation was handled so carefully by the City of Cupertino until democratic governor Newsom destroyed the deepened democratic process with a wrecking ball...You must remember that many Cupertino residents came from areas of the world where there is no democratic process; therefore this is beyond insulting and hurtful to the process...

Many school district officials also think since they are helping out children that anything they do is acceptable...I know all about that special kind of condescending hubris...And I also know that since you all know I am a powerful and unstoppable local journalist and activist and self-appointed Mayor of Southwest Sunnyvale who is questioning all of you -- that you all are taking the fifth right now because you are not only all apparently part of a conspiracy against truth -- but you are also frightened that you all did something major without required public approval...

And I also noticed that the Hong Kong deepened democracy story has all but dropped out of the news since publishing my blog post about it...Because let's face it; I made a very uncomfortable -- yet accurate -- description of current events and it made some people quite uneasy...Good then...Truth is a very powerful weapon is it not?

My point has always been for many years now that our system of american government does not like deepened democracy and never has...Deepened democracy means that all of the expensively purchased fake-ass government officials who were elected by special interests to do certain things will not have as much sway over proceedings...It also means bed ridden people will be able to vote about important issues online from their beds...Because if we can do multi-thousand dollar transactions online safely then we can also safely vote online too with some effort...

It also means the voices of average folks will rise and finally be acknowledged to bring betterment to society; so all of the things that were previously ignored can finally be addressed in a more broad fashion...

Questionable decisions made by larger groups of people will still exist; but at least those decisions will have been run by more people...Exactly like the situation I forced at the Peterson field a decade ago which brought about amazing results and permanent changes to our neighborhood; with a permanent bucolic SCUSD farm which helps to preserve our valleys' proud farming tradition...You're welcome...All for now..."

Most people in this region have no choice what city governments want to do within their cities...Except for maybe Cupertino; I have established the Birdland Neighborhood region as being a stronghold of deepened democracy in the Santa Clara Valley...Government may be able to jack around other lesser folks in this region; BUT NOT THE BIRDLAND NEIGHBORHOOD...and don't you ever forget it...
