CASE-RELATED INFORMATION 2019

The State of California needs to either amend their often abused denial of service law through increased regulation; or rescind the law altogether. The State of California spends an inordinate amount of time regulating their new legal pot market; but not nightclubs that serve alcohol. I refuse to accept any compensation for illegal ejections from private businesses of public accommodation until this law is either fixed or rescinded altogether due to it’s problematic qualities. 

And I will not be accepting any less than $500,000 dollars for the roughly 20 years of on and off police misconduct I experienced -- It’s been a nightmare from HELL that I want to finally END... 

After $11 million dollars was paid out to the Black Woman’s Book Club on the Napa Wine Train; loud alarm bells should have gone off and the State of California's system of ejecting often innocent people from private businesses of public accommodation should have been given a second look and then fixed; but it was not. 

I even alerted the State of California DOJ (Susan Lee) in the months before returning to the Oasis Nightclub; but not only did they refrain from contacting the Oasis Nightclub to inform them of their rights; but I also got my civil rights violated once again by being illegally ejected from the club while performing First Amendment-protected activities. (See: prior knowledge)

A new online state-run system is needed to display business codes of various businesses online so people who (for instance) drive long distances to various private businesses of public accommodation can be aware of what is expected of them before they drive all the way there and get ejected for wearing the wrong clothes or whatever. These businesses should perhaps be given 6 months to a year to come up with their unique business codes drafted by lawyers to be in line with the law before being held accountable. And if not; pre-prepared basic business codes provided by the state can perhaps be used as temporary business codes until lawyers can draft others for them. The Red Hen incident showed that this is clearly a bipartisan issue not affecting one side of the other; as anyone can be arbitrarily illegally ejected.

Therefore; not only does the State of California need to shore up their civil rights protections; but the federal government needs to step up as well and create new federal legislation designed to fix this discriminatory mess.

THE OFFICER GIBO INCIDENT: A few months back Sunnyvale DPS Officer Gibo responded to a call late one night about something that happened just up the street from here. He needed surveillance footage to see who the culprit was. So I offered to pull up the surveillance footage and leave it for Officer Gibo in a thumb drive the next day; which I did. But apparently Officer Gibo did not return for the thumb drive for a few days after this; not until I alerted the Sunnyvale City Council and the thumb drive finally got picked up and reviewed. This shows that  perhaps the Sunnyvale police are getting a bit better at responding to calls for gathering surveillance footage evidence; but it also shows I was discriminated against back in 2013 at the Oasis Nightclub when POS/DPS Officers Smith and Ochoa refused to pull up surveillance footage of KJ Doug at the Oasis. (Note: Notice no POS acronym for Gibo? Officer Gibo was a good human being and very nice unlike other officers I have dealt with...roughly 2 out of 10 officers were very nice people)

Note: I spoke to a Santa Clara Police Detective who told me that a whole bunch of bad apple Santa Clara police officers were asked to retire a few years back; officers who likely violated rights along the way...So if these corrupt officers were compensated regardless of their violations; the individuals who got their rights violated by them need to be equally compensated for their losses and uncivil injuries as well...

I am also wondering why some fraud seems to be acceptable for some; while for others fraud and/or dishonest behavior is not acceptable and even considered to be a criminal act. For instance; why was it ok for the Slanderous Semi-Psychopathic Social Worker to lie about the events of 20 September 2016? And why was it ok for Mrs. Rebholtz to lie on her testimony in June of 2011? 

And why was it ok for POS/SCPD Officers Seagrave and Lopez to lie as well? How about Mister and Mrs. Strubles’ conspiratorial fraudulence? Or what about the IRS/CFTB making grossly overstated claims about taxes I owe supposedly based upon multiple employees I do not have? Question: Why did the CFTB ignore H&R Blocks’ appeal of their fraudulent IRS/CTFB claims? And why can almost everyone else can lie; while I am expected to be honest?

Not only did Mrs. Rebholtz make false statements; but her entire dialogue went south as Jake Paolinetti later confessed to the years long stalking harassment menacing campaign in December of 2011; roughly six months after the Rebholtz party incident -- and Sunnyvale DPS either obstructed justice  and/or was too lame to put two and two together and unravel the lies.

This information puts the latest “White Entitlement” argument into serious question. Because if white people are so damn entitled like so many claim they are; then why was I allowed to be viciously attacked and harassed and stalked and menaced w/vandalism without any arrests made much like a minority during the pre-civil rights era? Am I entitled to being treated badly now due to this false narrative? Once again; the truth is low income white males are inordinately discriminated against in this region. So much for that half-truthed 'White Entitlement' narrative...

The main problem I experienced in court is unspeedy justice. The United States Constitution mandates speedy trials and/or justice; but population numbers have drastically increased since the 1700s; so something must change.

The courts need to take less time on ego-based pomp and circumstance and get down to business sooner by letting people get up and speak their initial oral arguments in the morning right after they arrive instead of waiting around until noon to speak. Trial lawyers providing counsel representation for defendants can often get paid up to $200+ dollars per hour; so this foot-dragging practice not only wastes precious time; but also money as well.

Adding to all of this; the traffic situation in my neighborhood has gotten absolutely unbearable lately. Hoards of unrestrained traffic pours into the old Raynor School /Stratford School campus and the Patrick Henry campus as well all day long and into the night. Stratford School has people coming and going up to 6-7 pm ~ while the Statford School in Saratoga (which I deliver magazines to) is in a better location that does not disaffect neighbors; and closes earlier without generating so much traffic.

(Local control is needed for neighborhoods regarding subjects other than pot clubs; because it is deceptive for the State of California to pretend people only want local control when it comes to legal marijuana. And the Proposition 64 initiative was deceptive in calling it self a recreational pot law and promising not to disaffect Proposition 215 users; when on January 1, 2018 all Proposition 215 users were badly disaffected by this forced and deceptive change)

The stress involved in dealing with Tom Foley and Mister Olenak and others who gave me grief during that time around 2006 or so ended up giving me an eye twitch that was bugging the shit out of me...At one point I somehow ended up going to Bogart's Lounge in Sunnyvale for a weekly jam night and BBQ; hanging around with black guys and finally really fully understanding what many blacks often get so damn pissed off about all the time (in other words; civil rights violations and/or police misconduct) Then one night I was smoking a joint of the bass players' weed; and my eye twitch immediately went away...It was at that point that I realized marijuana actually had medicinal value; so I went and got a prescription about ten years ago and never looked back until Proposition 64 came along and screwed the whole thing up...Adding to all of this; while recently focusing on that era and writing about it; the eye twitch came back!?! (as it has other times I have focused upon that time period...probably PTSD or something) and it occurred to me that CBDs may help; so I bought some yummy CBD gummies from a local liquor store and the twitch went away again...

I was essentially temporarily intimidated out of attending Sunnyvale City Council meetings years back with all of the police-sponsored KKK/Nazi-style night time disturbances allowed by the RPF and/or POS/DPS; therefore I did not attend any public hearings regarding that property. (UPDATE: 20 NOV 2019 / The NSA-chatter seen in the link below magically popped up the morning after publishing this blog post...It's the usual push-back I get when I bring up the fact that the RPF used KKK/Nazi-style tactics during their multi-year harassment campaign against me...And Mister Olenak's son Danny once scrawled swastikas into fresh cement at a Jewish neighbors' house; a neighbor who moved out of the neighborhood after this incident...So if anyone is a white supremacist it's Danny Olenak and/or his Father Mister Olenak (Mister OIenak once called the police for an Asian man sitting in a vehicle outside his house...Turns out the Asian man was a 'secret' investigator for then SF Mayor Willie Brown; who I had just started an email conversation with...Ha ha busted!...) During this down time; Cupertino Planning Commissioner Don Sun became my good friend and helped me out here and there with part-time employment to help me get by as George Hills was off supposedly investigating all of this; leaving me broke and desperate and even starving at times waiting for them to get back to me. But this is the norm for Silicon Valley; as countless low income lives get thrown in the trash regularly; living in RVs and tents etc. 

Don Sun is a really good guy who I would like to publicly thank for his help...

Don Sun has promised to increase traffic calming surrounding the new Apple  Spaceship and the new behemoth apartment development at Lawrence Expressway and Halford Avenue. Traffic counter strips have recently been placed on Thunderbird Avenue etc; but the traffic numbers on Dunford Way are never honestly counted; as temporary traffic strips installed on Dunford are always pulled up quickly; and never left out to count weekend traffic.

My neighborhood has become a dumping ground for people who do not even live in the neighborhood; as most entering are from other Silicon Valley regions. Back in the 1990s; the frequency of vehicles traveling on Dunford Way on an average day was about one vehicle per 13 seconds at the height of the dot com boom. Now at peak traffic times there is no break in the traffic; it is constant and I hear every vehicle speeding by my residence from about 7:30 am on.

Many other lesser souls have turned and run by moving from this area; while I have no intentions of doing so (yet anyway). Before I leave and/or if I ever leave this neighborhood; the permanent traffic calming promised by the City of Santa Clara WILL BE ACCOMPLISHED for the future residents of this neighborhood; whether I live here or not ~ because it’s not any less illegal or wrong when local governments make fraudulent claims than anyone else.

Note: Ex-Principal Harris is a good friend of Mrs. Paolinetti; therefore this unusual incident was very likely an illegal; conspiratorial set-up ~ along with the SWAT team called for my litter cleanup activities with Steve Henson being at the Peterson field right before this incident. This was the only time I had seen Steve Henson (Officer Paolinetti’s close friend) at the Peterson field in the morning when exercising. Sunnyvale POS/DPS had TONS of prior knowledge about the litter cleanup activities I was doing at the time; including a green card filled out by a latino male DPS offcer a few weeks before the illegal; egregious rights violating raid on my residence...

 And my DoD buddy “T” claimed Sunnyvale POS/DPS did this illegal SWAT team raid because they “have it out for me”; which I believe to be true. See “TIMELINE” link below.

(Adding to all of this; a crosswalk is needed on Wood Duck Avenue where it intersects Benton Street; as Lake terrace residents presently cannot legally cross Wood Duck Avenue)...

The most glaring example of police misconduct was getting thrown down and bloodied up in the very same crosswalk I was responsible for having installed; and under the same duck crossing signs that I had installed as well; talking about ducks ex-Mayor Judy Nadler gave me permission to feed at a Santa Clara City Council meeting. Then being abruptly let go after I told POS/SCPD Officer Lopez that I actually had $60,000 dollars in the bank at the time; due to class-based discrimination that runs rampant in police departments all over.

Life insurance monies left by my deceased brother that slowly dwindled away during the extended years-long police-sponsored RPF seige on my residence that was done to destabilize and subjugate me for my valiant activist efforts; leaving me broke and desperate and nearly starving at times in the years after. It’s obvious that local governments have created such a traffic nightmare in the Silicon Valley that they are now struggling to figure out how to deal with it. And it is a HUGE liability for local governments to have all of this prior knowledge of multifarious traffic-related problems and still do nothing about them.

I get the strong feeling that if I did not bring up George Hills Companys’ 2014/2015 promises of investigation; that it would  likely never occur. I would have been forgotten about like my life did not matter and thrown in the trash.

Which may happen anyway due to my low-income white male status; forcing me to file a lawsuit to finally receive compensation that was due a decade ago.

And Sunnyvale POS/DPS protected yet another active threat outside my residence once again in 2019 with KJ Doug Ward. Tom Foley was one of the first ignored and carefully protected active threats let go by police (Tom Foley was a drunk felon at the time who should have been arrested for parole violations) then Mister Olenak etc etc. Apparently because I am a low income white male (activist) and/or  because I was a targeted individual at the time; (whatever their stupid reason was) no action was ever taken to help me out. For instance; Jake Paolinetti and the entire RPF was a police-sponsored active threat outside my residence for a number of years; as Jake often used his fathers’ vehicles for the harassment/stalking. It was domestic terrorism plain and simple; because if middle eastern folks were doing the exact same thing; they would be charged as terrorists. 


And not only was nothing done to stop the RPF; but my safety was also put at further risk by giving a retraining order to the wrong person. Roughly six months after the bogus retraining order was issued; it looks a whole lot like Jake Paolinetti killed one of the best cats I ever owned; Precious Cat. Causing me to sleep in until 11 am for about two years until I finally snapped out of it realizing I did not want to miss the last years of my father’s life; a 94 year old father who had a stroke recently at the end of the years-long RPF seige.

Question: Why were all of these evil freaks allowed to violate my civil rights? 

"UPDATE / 9 January 2015: I was out exercising on Friday 8 Jan 2015 when I came upon a lady; an old neighborhood friend. The lady (who will remain anonymous for now unless later needed) is the mother of someone I went to school with at Laurelwood Elementary School many years ago. In conversation; the subject of the Paolinetti family came up (this particular lady lives near the Paolinetti family) and she claimed that many of the neighbors who live adjacent to the old Paolinetti family house were exposed to a living hell of parties and noise coming from the Paolinetti house. One time an arrow allegedly came flying over the fence. "A gang" is how the lady described them (similar to my own description); "very good looking kids who you would not expect to do this kind of thing" she also added. She said that Mister Paolinetti was not a regular cop; but instead a cop "who did paperwork for the other cops" adding that "cops did not want to get Mister Paolinetti in trouble" for some reason unknown; as if they feared Mister Paolinetti or something. The Paolinetti moved out of their house in February 2014..."

Note: When I was a teenager I played drums with a rock band at impromptu parties all over the Santa Clara Valley; and more often than not a few songs into the set police would show up to stop the music due to complaining neighbors who were trying to sleep. The police would make the band shit Major Bricks by threatening to confiscate our equipment; and the music was stopped. Major Bricks was not utilized on the RPF for similar noise abatement purposes in this instance to "scare them straight" so to speak. No action was taken by SCPD and/or DPS to stop the RPF. Instead the RPF's actions were facilitated by SCPD and/or DPS; allowing violations to continue...

VARIOUS OBSTRUCTION OF JUSTICE/STONEWALLING ATTEMPTS:
(not necessarily in order of occurrence)

1) The first stonewalling/obstruction of justice I can think of was Tom Foley; who like I previously mentioned was a drunk felon at the time lying in wait conspiratorially with the blessings of the owner/lawyer of Lake Terrace Apartments and his apartment manager who quit her job right after this when I confronted Tom Foley and the apartment manager and got him to admit to all of this in front of a witness friend of mine (Tom Foley should have been arrested for parole violations) 2) The second time I can remember was “Peck” the UC Officer who kicked my van door in and later left threatening messages on my doorstep (see: Trespassing Bagger link below); causing the window of the first new vehicle I ever owned to still not work almost a decade later when I need it for work. And this happened as I was going to my friends’ house on Wood Duck Avenue; not feeding ducks like he suggested. 3) Then Mister Olenak attacked me and instead of arresting Mister Olenak for following up on previously made threats of violence; Officers Seagrave and Lopez used him as a “witness to duck feeding” along with Tom Foley at a mob style sit-down administrative hearing to extort money out of me!?! Unfuckingbelievable! 4) Yet another obstruction of justice occurred when I filed a complaint to the City of Sunnyvale in 2015 and did not receive reciprocal communications. Pretend you never saw that. 5) Then another one when promises to investigate by George Hills Company were apparently not honored; 6)  And yet another when Lee Bagley was dragged into court without warning and compensated when the City of Sunnyvale knew I was planning on combining both cases for increased compensation due to pattern and practice laws without statutes of limitations. 7) Another occurrence of obstruction of justice deals with the City of Santa Clara and Sunnyvale playing dumb and pretending they did not know what my case was about when I have spent literally about 3000+ hours explaining it to them over the years. This leads me to believe that city government and their employees are either REALLY STUPID; or they pretend to not know what I am talking about to stonewall and obstruction justice a little more. (The Trump administration is not the only government entity that stonewalls and obstructs justice in other words; all levels governments regardless of political affiliation do this on a regular basis to get their way in court) The bottom line is: this situation would not have festered to the point it did unless government and police were totally inept. Why else would this be allowed to happen? Leading me to believe they cannot defend themselves successfully in court either due to their obvious governmental ineptitude. 8) Attempting to violate my unalienable First Amendment rights at the June 2011 court hearing by requiring me to be silenced about my various abusers and the years-long siege on my residence was not only a violation of my basic rights and/or civil rights and/or stonewalling; but it was also mainly yet another lame and unsuccessful attempt to silence me. 9) There is no number 9 yet; but you know damn well this is a 1-100 kind of thing...

This is yet more evidenciary material proving that John was being stalked and harassed long before the RPF accused him of what the RPF was actually doing. This appears to be a Sunnyvale Fire Department employee (and/or police officer) and UC Officer Peck leaving threatening messages. (See links)

In retrospect; I'm 56 years old now and my bullshit filter is clogged from all of this but that does not stop me from seeing the light. I've been around the block a few times so I know shit from shinola; and THIS WAS A BUNCH OF SHIT. This was all about activism from the beginning back in 1998;  from permanent traffic calming installed on Dunford Way at my request ~ to saving the the Peterson field from developers.
